Terms of Service

These Terms of Service (“Terms”) govern your use of the Terrayap mobile app and web app (together, the “Service”) provided by KSD Apps (KSD Inc., Toronto, ON, Canada, “we”, “our”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your country, whichever is higher, to use Terrayap. By using the Service you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms.

2. Your account

• You sign in with your phone number. Keep your device and paired browsers protected.
• You are responsible for activity on your account and on any device paired to it.
• You may link the number of devices allowed by your subscription tier. Paired browsers can be revoked from the Linked Devices screen at any time.
• We may suspend or terminate an account that violates these Terms, abuses the Service, or infringes on other people's rights.

3. Subscriptions, billing, and character usage

• Terrayap offers a Free tier and paid tiers (Pro, Premium, Enterprise). Prices and limits are shown in the mobile app's Subscription screen and may change with notice.
• Subscriptions are billed by Apple or Google (via RevenueCat) through the mobile app. The web app is a paired companion and does not sell subscriptions; your tier follows the mobile account that paired the browser.
• Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You may cancel anytime; access continues until the end of the paid period.
• Character-usage counters reset at the start of each billing period. Unused characters do not roll over. Consumable character packs (e.g. 10,000 characters for $10) are added on top of your plan allowance and reset along with the plan allowance each period.
• We may change prices with at least 30 days' notice. If you disagree, cancel before the change takes effect.
• No direct refunds. All purchases are final and non-refundable from KSD Inc. Refund requests, where applicable, must be made through the platform that processed the purchase (Apple App Store or Google Play) under their own refund policies. We do not issue refunds directly, except where required by law.

4. Acceptable use

You agree not to use the Service to:

• Harass, threaten, impersonate, or harm another person.
• Send spam, unsolicited bulk messages, or phishing content.
• Send content that is illegal, infringing, hateful, sexually exploitative of minors, or that violates the rights of others.
• Clone or synthesize the voice of any person without their clear, informed consent. Voice cloning is strictly for your own voice; you are solely responsible if you upload someone else's voice without permission.
• Circumvent usage limits, reverse-engineer the Service, or use automated scripts to generate traffic.
• Upload or transmit viruses, worms, or other malicious code.
• Use the Service in a way that violates any law or regulation applicable to you.

We may remove content or suspend accounts that break these rules, and we may cooperate with law enforcement when required.

Terrayap provides in-app blocking and reporting tools. We review user reports of objectionable content within 24 hours and, where a violation is confirmed, we remove the offending content and suspend or permanently eject the offending account.

Terrayap does not proactively monitor private chats; reviews are triggered by user-submitted reports.

5. Your content

You retain ownership of everything you send through Terrayap (your messages, voice recordings, photos, documents, voice sample, and profile information). You grant us a limited license to store, transmit, translate, transcribe, and synthesize this content solely to deliver the Service to you and the people you send it to. This license ends when the content is deleted (per the retention rules in our Privacy Policy).

We do not claim ownership of your content and we do not use it to train third-party models outside the necessary processing for translation, transcription, and voice synthesis.

6. Voice profile consent

By recording a voice sample and enabling voice cloning, you certify that the sample is your own voice and that you consent to Terrayap generating synthetic speech in that voice for translating your messages. You can revoke your voice profile at any time in the app; the sample and the third-party model derived from it will be deleted.

7. Third-party services

Terrayap uses third-party services (listed in the Privacy Policy) for translation, transcription, voice synthesis, storage, hosting, push notifications, and billing. Your use of these services through Terrayap is also subject to their respective terms. We are not responsible for the availability, accuracy, or performance of those services.

8. SMS verification

When you sign in or create an account, Terrayap sends a one-time SMS verification code to the phone number you provide via our SMS partner Twilio. Standard message and data rates may apply per your mobile carrier's plan; Terrayap does not charge for SMS verification codes. You may opt out of these messages at any time by replying STOP to any verification SMS. Replying STOP will prevent you from signing in or creating new accounts on this phone number until you reply START to resume. For full SMS handling details, see our Privacy Policy.

9. App Store and Google Play (Apple/Google licensee terms)

If you obtained Terrayap from the Apple App Store, you acknowledge that these Terms are between you and KSD Inc. only, and not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the Service. Any claim relating to the Service's failure to conform to legal or regulatory requirements is the sole responsibility of KSD Inc. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. The same provisions apply, with Google Inc. substituted for Apple Inc., where you obtained Terrayap from Google Play.

10. Intellectual property

The Terrayap name, logo, app, website, and source code (other than your content) are owned by KSD Inc. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

11. Disclaimers

The Service is provided “as is” and “as available.” Translations and synthesized speech are generated by third-party AI models and may contain errors, omissions, or inappropriate output. Do not rely on Terrayap for legal, medical, financial, or safety-critical communications. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, KSD Apps, KSD Inc., and our officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or business interruption) arising out of or related to your use of the Service. Our total liability for any claim related to the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim, or CA $100, whichever is greater.

13. Indemnification

You agree to defend and indemnify KSD Apps, KSD Inc., and its affiliates from any claim, loss, or expense (including reasonable legal fees) arising from content you send or receive through the Service, your violation of these Terms, or your violation of any law or the rights of another person.

14. Termination

You may stop using the Service and request account deletion at any time (see Privacy Policy section 7). We may suspend or terminate your access if you violate these Terms or if continued operation is not commercially viable for us. Sections 5 (Your content), 7 (Third-party services), 10 (Intellectual property), 11 (Disclaimers), 12 (Limitation of liability), 13 (Indemnification), 15 (Governing law), and 16 (Changes) survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be resolved in the courts of Ontario, Canada, and you consent to the exclusive jurisdiction of those courts. If you are a consumer in a jurisdiction whose laws grant you the right to bring a dispute in your local courts, nothing in this section removes that right.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in-app or by email. Continuing to use the Service after an update means you accept the updated Terms. If you do not agree, stop using the Service.
